Idiot judge finds Mt. Soledad Cross unconstitutional

In a direct slap in the face of an overwhelming majority of voters, Superior Court Judge Patricia Yim Cowett has found Proposition "A", the save the Mt. Soledad War Memorial Cross measure, unconstitutional. Prop "A" was the initiative on San Diego's July 2005 special election to save the Mt. Soledad War Memorial Cross by transferring it to the U.S. Interior Department as a national veterans memorial which was approved by an astounding 76% of voters.

The day after the election, attorney James McElroy, whose client, atheist Philip Paulson, filed a lawsuit challenging the presence of the cross on city land in 1989, called the vote meaningless. "It still doesn't mean a damn thing," he said. "Voters should have never voted on it. It's a waste of taxpayers' money."

San Diego's has a preliminary report:
SAN DIEGO -- A Superior Court judge has just ruled that Proposition A is unconstitutional.

"The court hereby finds the ordinance placing Proposition A on the ballot and Proposition A unconstitutional, and therefore invalid and unenforceable. Maintenance of this Latin Cross as it is on the property in question, is found to be an unconstitutional preference of religion in violation of Artical I, Section 4, of the California Constitution, and the transfer of the memorial with the cross as its centerpiece to the federal government to save the cross as it is, where it is, is an unconstitutional aid to religion in violation of Artical XVI, Section 5, of the California Constitution."

I, for one, am outraged at this ridiculous ruling. Be sure that the Thomas Moore Law Center and others will not let this rest.

UPDATE: Bill at Daily Pundit linked to this post with his own commentary stating: "One of the biggest problems in approaching issues like these is trying to explain to people that the laws prescribed by the Constitution are not matters of majoritarian debate. In fact, the people have no direct role to play in voting on the Constitution at all, not even in a hypothetical Constitutional Convention, and certainly not in the amendment process. In fact, they never have had such a role."

Bill is, indeed, correct and it was not my intention to intimate that a vote trumps the constitution. The point is that in issues like these, it is equally incorrect to ascribe a hostility toward public religious expression to the constitution. After 16 years of litigation and much judge shopping, Paulson and McElroy continue to rely on finding "the right judge" to try advance their agenda. This is just the latest in a series of costly and divisive maneuvers that pair has foisted on the people of San Diego.

Judge throws out ACLU/NARAL lawsuit against "Choose Life" license plates

In a victory for free speech, a Federal Judge threw out an ACLU/NARAL lawsuit seeking to ban Ohio license plates with the "Choose Life" phrase. As usual the "pro-choice" hypocrites sought to stifle real choice and impose their own twisted views on the rest of us carried an article:

Columbus, OH ( -- A federal judge has thrown out a lawsuit by abortion advocates seeking to overturn a measure allowing state residents to purchase Choose Life license plates for their vehicles. Funds raise from the sale of the plates would benefit pregnancy centers that help women find abortion alternatives.


Nugent ruled that federal law prohibits federal courts from interfering with state's collecting taxes, like the fees motorists pay for the license plates.

Mathew Staver, president and general counsel of Liberty Counsel, which argued on behalf of the Choose Life plates, told CNS News, "Just as Ohio can warn of the health consequences of smoking, so the state is entitled to make a value judgment favoring childbirth over abortion."

"If those who call themselves 'pro-choice' were genuinely concerned about the best interests of women and children, they would welcome a pro-adoption message. Their actions betray their rhetoric," Staver added.


Thirteen states have adopted Choose Life license plates, where proceeds benefit pro-life groups, adoption agencies, and pregnancy help centers. Those states include Alabama, Arkansas, Connecticut, Florida, Hawaii, Louisiana, Maryland, Mississippi, Montana, Oklahoma, South Carolina, South Dakota and Tennessee.

License plates backing abortion have been approved in Hawaii and Montana.

There is hope. Judges, such as Donald Nugent, are again basing their rulings on what the law says rather than inventing "rights" which promote death.

Mt. Soledad Cross battle is not about the Constitution but an attack on Christianity

Philip Paulson, the man who has been fighting to remove the war memorial cross from San Diego's Mt. Soledad, and his lawyer James McElroy haven't exactly been keeping their hatred for Christianity a secret.

From the Thomas More Law Center:
RANCHO SANTA FE, CA -- For sixteen years atheist Philip Paulson claiming he wants to maintain neutrality between government and religion, has been waging an unrelenting war against the Mt. Soledad Cross that is the centerpiece of the historic Veterans Memorial in San Diego. However, Paulson's comments on the website of the Atheist Coalition of San Diego reveals his true motivation is hatred for Christianity.

Paulson goes so far as to state; "We need to attack Jesus..." Those comments, followed by vulgar remarks about Christ, God and the Virgin Mary are so crude and offensive that the Thomas More Law Center will not repeat them. However, Richard Thompson, President of the Law Center commented, "These remarks show the plaintiff to be nothing more than a foul-mouthed anti-Christian whose agenda is not to defend the Constitution, but to attack Christianity."

ACLU fights abstinence education programs

Paul M. Weyrich has written an excellent piece defending abstinence education and debunking the silly and misleading arguments against it by organizations such as the ACLU.

Accuracy in Media carries Weyrich's column:

Abstinence education has a good friend in the Bush Administration. After all, abstinence is the only proven and effective safeguard against unplanned pregnancies and sexually transmitted diseases (STDs). Good causes in Washington usually earn the enmity of powerful reactionary forces and that is certainly the case with abstinence education: the American Civil Liberties Union (ACLU) rejects abstinence education and wants it stopped...

If ACLU were to have its way local supporters would soon flood local school superintendents with communications claiming that abstinence-only education was harmful and dangerous and would put teenagers at risk. How ACLU could say that is beyond belief. Premarital sex really puts teenagers at risk. Think of it this way. If you never held a loaded gun to your head and pulled the trigger the odds of your dying from a self-inflicted gunshot wound to the head would be zero. For those who practice abstinence before marriage the odds of contracting sexually transmitted diseases (STDs) would be zero and the chances of premarital pregnancy would be zero.

Fortunately, people are waking up from the 1960's free love deception. Weyrich urges vigilance:

Our country is beginning to regain some of its moral bearings from the 1960s aftershocks. The ACLU campaign threatens to undo the progress we have made. Americans of conscience should not permit that to happen.

California Prop. 73 - Parental Notification Initiative

The fur is already flying in the fight over the various initiatives on California's November ballot. An important initiative is Proposition 73, the "WAITING PERIOD AND PARENTAL NOTIFICATION BEFORE TERMINATION OF MINOR'S PREGNANCY. INITIATIVE CONSTITUTIONAL AMENDMENT."



  • Amends California Constitution, prohibiting abortion for unemancipated minor until 48 hours after physician notifies minor's parent/legal guardian, except in medical emergency or with parental waiver.

  • Defines abortion as causing "death of the unborn child, a child conceived but not yet born."

  • Permits minor to obtain court order waiving notice based on clear, convincing evidence of minor's maturity or best interests.

  • Mandates various reporting requirements.

  • Authorizes monetary damages against physicians for violation.

  • Requires minor's consent to abortion, with certain exceptions.

  • Permits judicial relief if minor's consent coerced.


Potential unknown net state costs of several million dollars annually for health and social services programs, the courts, and state administration combined.

Governor Schwarzenegger has endorsed the initiative. Of course, Planned Parenthood has come out against it as has Deborah Burger, President of the California Nurses Association -- Florence Nightengale, where are you?

A Letter to ACLU Members

One of the most common comments and hate mails I get besides the "you are a nazi that hates freedom" ones, is the infamous "You just inspired me to give $100 to the ACLU", or the "I just re-upped my ACLU membership" ones. This post was inspired by you people.

Dear Mr. or Ms.ACLU member, please work with the ACLU to reform some of their policies. Please get them to disclose their Policy guide so everyone can see what they truly stand for. If they are truly about freedom, they should have nothing to hide.

Please work with them to reform their position on the second amendment. If they are truly to be the defenders of the Constitution, it should be the entire Constitution and not just what is in line with their agenda.

Tell them that the First Amendment applies to everyone, not just those that agree with their interpretation. Let them know that Pro-life demonstrators should have their free speech defended as well, and not ignored. Civil liberties should not be a selective process if you are to claim protecting it for all. If the ACLU cared as much for pro-life free speech as it does for NAMBLA their integrity on their claim to be might not be so questionable.

Ask them to work with the government instead of against it in homeland security issues. I'm sure they will come to some dead ends and disagreements, but a positive outreach to show they actually care about American security more than the imaginary rights of some terrorist could do wonders for their tarnished image. Refusing money from loyal contributors because they don't want their money to go towards the advancement of terrorism makes many Americans leery on giving their money too. It also might help if they didn't work with organizations known to have terrorist ties.

Please talk to them about completely dropping their position on child porn distribution legalization. It's just plain sick.

Let them know that comparing Christians to terrorists is not a good way to get new membership. And tell them I said to have a merry Christmas this year, and to take it easy on the baby Jesus stuff. Nobody's trying to create a theocracy. Tell them to relax, and enjoy the "winter break." And give everyone else a break about too. Best of luck with that membership, stop the ACLU Blogburst team.

The Gaza withdrawal. You can't tell the sides apart without a scorecard

Lets play a little game. I'll post some recent statements about Sharon's shameful withdrawal from Gaza and you try to guess what person or group said it.

  • A. Sharon was "very courageous" to carry out the withdrawal.

  • B. "We agree that the disengagement will make Israel stronger. ... this will bring our two countries closer together."

  • C. Israel must take further steps, including loosening travel restrictions in the West Bank and withdrawing from more Palestinian cities.

  • D. ... condemned as a "terrible act of violence" the shooting deaths of four Palestinians in the West Bank on Wednesday.

Who said it? Hamas, Abbas, Islamic Jihad?

Our government believes that these people deserve their own state. So does the UN. I don't. I share this opinion with millions of others. Rabbi Shmuley Boteach writes that "Sharon has turned America's Christian & Jewish communities against Israel"

... Well, chalk up yet another first to this stubbornly audacious man, for Sharon is the first Israeli prime minister in Israel's history to have caused Israel's staunchest allies, America's evangelical Christians, to come out against the Israeli government.

It is indeed a singular achievement to take your greatest friends and make them into enemies. Sharon has now done this twice. First, with the settler community, who were hoodwinked into believing that Sharon was their ally. But the loss of the settler community is of little concern to Sharon, who, judging from his contemptuous treatment of them, he couldn't care less for. But when it's 80 million American evangelicals who Sharon has alienated, maybe he should begin paying attention.

The news that CIPAC, the Christian Israel Public Affairs Committee, is now pressuring Congress to reject an Israeli government financial aid request, worth $2.2 billion, to fund the Israeli retreat from Gaza, is a grave embarrassment to the Jewish state.

Consider, if you will, an enormous group of Christian Americans, patriotic in the extreme, who have tied America's future to Israel's; who believe that the foremost foreign policy of the world's foremost superpower should be to protect a small and vulnerable nation halfway across the world from the United States; who believe in Israel's blessed place among the nations; and who believe that when the United States is not squarely behind Israel it is acting immorally. Can anyone ask for more stalwart allies than these?

I agree that not one dime of US aid should be spent to abet this capitulation. Not only does it severly compromise Israel's ability to control the murderous thugs, it emboldens terrorists everywhere by sending the clear message that the west can be beaten by terror.

ACLU Algebra: Prayer equals Terrorism

The more the ACLU opens its mouth the clearer it becomes just how out of the mainstream they really are. The latest anti-faith screed comes from Joe Cook, the director of a Louisiana ACLU chapter. Speaking on camera on WAFB-TV, Baton Rouge, about the New Orleans Tangipahoa Parish school district's 30 year tradition of opening school board meetings with a prayer, "Cookie" as we like to call him, said:
"They believe that they answer to a higher power, in my opinion. Which is the kind of thinking that you had with the people who flew the airplanes into the buildings in this country, and the people who did the kind of things in London."

Cookie, who really takes himself too seriously, has let the cat out of the bag. Cookie and, by virtue of his title, the Louisiana ACLU believes that anyone who believes in a god, any god, is morally equivalent to the 9/11 terrorists and the London homicide bombers. Cookie thinks a wee bit too highly of himself. He thinks that he is god and he is a very jealous god.
Mike Johnson, senior counsel and southeastern regional coordinator for the Alliance Defense Fund, said Cook has become increasingly outlandish in his statements.

"It shows the ACLU has become more and more extreme and marginalized," said Johnson. "So, to that extent, I like it when he talks, because he simply reveals who they are."

Johnson said the ACLU tries to "come across as champions of liberty, but the truth of the matter is they are extremists."

In a fit of psychological projection, the ACLU also says:
"The school board's consistent defiance of the law not only dishonors and endangers the Constitution, but it also sends a message of religious intolerance and polarizes the community."

I love the last phrase: "...sends a message of religious intolerance and polarizes the community." Isn't that exactly what good ol' Cookie's whole message is?

The thing that probably set Cookie off was [emphasis added]:
Cook made his comments to the New Orleans TV station while the ADF's Johnson was providing in-service training to the district's 1,500 staff and teachers, outlining the legal parameters in which they can express religious faith in a public school setting.

Cookie is really irate now because not only are those people praying, but they are actually learning something in a public school setting. THAT is too much for any self worshiping ACLU member to bear.

Has America Become an Ideological State?

Paul M. Weyrich has written a piece for Accuracy in Media entitled: "The Danger of the Ideological State."
If there is one clear lesson from the 20th century, it is that all ideologies are dangerous. As Russell Kirk wrote, conservatism is not an ideology, it is the negation of ideology. Conservatism values what has grown up over time, over many generations, in the form of traditions, customs and habits. Ideology, in contrast, says that on the basis of such-and-such a philosophy, certain things must be true. When reality contradicts that deduction, reality must be suppressed. And when an ideology takes over a state, the power of the state is used to accomplish that suppression. The state's citizens are forced to mouth lies.

One of the new facts the next conservatism must address is the fact that America, for the first time in its history, has become an ideological state. The ideology commonly known as "political correctness" or "multiculturalism" now shapes the actions of government in thousands of ways. Under the rubric of "hate crimes," it sentences American citizens to additional time in jail for political thoughts. As "affirmative action," it "privileges" women, blacks and homosexuals over heterosexual white males...


What should the next conservatism do about it? First, it needs to reveal this ideology for what it is. In terms of its historical origins and basic nature, it is Marxism translated from economic into cultural terms. The translation was undertaken largely by the unorthodox Marxists of the Frankfurt School – Horkheimer, Adorno, Fromm, Reich and Marcuse, to name the most important players...


The next conservatism needs to shout from the housetops, "People, here's what this stuff really is. It's not about 'being nice' or 'toleration.' It's about destroying our culture and our religion, and it is succeeding."

Brits steal carloads of Austrian roadsigns

An Austrian village called F**king will not change its name despite sniggering Brits making off with its roadsigns.

Mayor Siegfried Hauppl has asked visitors to lay off the signs which began to attract outside attention after British and US soldiers passing through in 1945 illuminated the locals as to the English meaning of F**king, Ananova reports.

Gush Katif disengagement - vanity of vanities

The utter idiocy of the Gaza Disengagement plan is stunning. While Israel pursues “Land for Peace”, the Palestinians have done nothing to disarm or disband the terrorist groups. The Palestinians do not even acknowledge Israel's right to exist, yet the eviction of Jews from Jewish territory commences. Aaron Klein of WorldNetDaily reports from Gush Katif [emphisis added]:
GUSH KATIF BLOCK, Gaza – Israel's evacuation of Jewish communities from Gaza and parts of Samaria officially began tonight with the complete closing of the Gaza Strip just a few moments ago, while residents here blocked army vehicles headed toward their communities, and Hamas fired mortars and shot at soldiers.
Tuesday, 50,000 soldiers and police officers are slated to form six rings in and around Gush Katif. The first ring, consisting of some 20,000 forces, mostly police, will be sent into the Jewish communities to carry out the actual evacuation. About 17 to 20 officers per Katif home will be used to physically drag occupants onto waiting buses and out of the area.
After the Kissufim crossing was closed, protests broke out at the main gate, and on the access road outside Neve Dekalim, the largest Katif settlement. Dekalim residents threw themselves atop several army and police vehicles headed in the direction of their community.

"Don't uproot us. Refuse orders," one woman screamed as she stood in front of an army Jeep.

Teenagers, including non-residents who managed to infiltrate the area the past few weeks, gathered around two army trucks and began pounding at the windows.

"Jews do not evacuate Jews," a crowd of about 80 children chanted.
Tonight's Hamas attacks highlight fears the Gaza evacuation will be carried out under fire. The Israeli public has stated in multiple opinion polls they would not support any withdrawal activities during Palestinian attack.

In a rare press conference this morning, Hamas leaders declared the withdrawal a victory for terrorism, and vowed to continue fighting Israel until "all territories" are "liberated."

"Hamas remains committed to the choice of resistance. Hamas remains committed to its military wing and its right to possess weapons," said Hamas spokesman Ismail Haniyye.

Hamas spokesman Abu Anas declared, "We will keep our weapons in hand until we liberate all our land. Gaza is the beginning. We will not lay down our weapons after the Zionists withdraw from Gaza because the road ahead is long."

"...vanity of vanities; all [is] vanity." Israel deserves better than the whipped Sharon. Sharon has been pushed, with little perceptible resistance on his part, into this suicidal leap by "The Quartet" (The United States, Russia, The EU and the UN.) Hal Lindsey writes: [empaisis added]
The Quartet, led by the French, forced Sharon to ‘coordinate’ with Abbas in order to ensure a ‘smooth transition’ of power, turning what had been a tactical offensive move into a humiliating military defeat. Sharon was committed to the withdrawal, but the Quartet handed all the best bargaining cards to Abbas.

Not only did the French ‘initiative’ on behalf of the Quartet stick a bayonet into Sharon’s back, it handed global terrorism a resounding victory.

Al-Jazeera made the Islamic world’s perception clear, “However, some analysts believe that, whether Israel likes it or not, the atmosphere that will prevail during the evacuation process will certainly show Israel as a defeated state, while the Palestinians celebrate and reap the fruits of their armed conflict.”

UPDATE: More on the pullout:
Abbas issued a statement praising the pullout but said it must be followed by more.

"The Israeli withdrawal which starts today is a very important and historical step, but it is an initial step that should take place not only in Gaza, but in the West Bank and East Jerusalem," he said.

And what, exactly, has Abbas done to keep his end of the bargain?
"Hamas activists in Gaza City hung banners Monday proclaiming the pullout was a result of attacks by militants on Israelis."

Tisha' be'Av - Jewish day of mourning.

August 14th of this year is the Jewish Tisha' be'Av (the 9th day of the month of Av). Tisha' be'Av is a day set aside to commemorate woes that have afflicted Israel throughout history. Yoram Ettinger at Israpundit has posted a list of the remarkable calamities which are attributed to this day:
1. The Ninth Day of the Jewish month of Av (August 14, 2005) commemorates a series of major Jewish calamities:

*The Golden Calf (1312 BC);
*The failure of the "Ten Spies", which caused 38 additional years in the desert;
*The destruction of the First Temple (586 BC), 100,000 killed and a nation exiled;
*The destruction of the Second Temple (70 BC), 2 million killed and a nation exiled;
*The crashing of the Bar Kokhba Rebellion (135 AD), 100,000 killed;
*The pogroms of the First Crusade (1096), scores of thousands slaughtered;
*The expulsion of the Jews from Britain (1290);
*The expulsion of the Jews from Spain (1492);
*The eruption of WWI (1914)
*The end of the Warsaw Ghetto Uprising, and the massacre of 50,000 survivors in concentration camps; (May 1943).

4. The Book of (5) Lamentations (Megilat Eikhah) is read on the Ninth Day of Av, reminding us of the state of the Jewish Nation following the destruction of its religious and national infrastructure.

5. Emperor Napoleon was walking at night in the streets of Paris, when he heard weeping and crying emanating from a nearby synagogue. When told that the wailing and lamenting commemorated a catastrophe, which took place in 586 BC, he declared: Any People which solemnizes its ancient history in such a manner is destined for a glorious future!


Let us all pray that on this Tisha' be'Av the Israeli withdrawal from Gaza is not added to the woes commemorated in the coming years.

UPDATE: It is unconscionable that Sharon and the Israeli government are so set on abandoning Gaza to the world's most intransigent people. Adding to the ignominy of trading land for guaranteed escalation of terror activities is the brainlessness of starting the eviction of Jews on Tisha' be'Av. It is no coincidence that the timing is as it is - coincidence is not a Kosher word. Modern Israel has a choice to make. Ignore God and history and keep to the path it is currently on or turn as a nation back to God and embrace the Abrahamic Covenant. One path leads to destruction, the other leads to God's peace through strength and security. I fear that the time of Jacob's Trouble is near at hand.

Gasp! Barbara Boxer will use abortion litmus test on Roberts

California Senator Barbara Boxer loves to speak at pro-abortion rallies. The only concept that can make it through the head of the country's dumbest senator is "Abortion:Good, Pro-Life:Bad." Her latest departure from reality manifested itself at a pro-abortion rally at Golden Gate University in San Francisco.

An article on states:
Pro-abrotion Sen. Barbara Boxer of California says she will filibuster the nomination of John Roberts to the Supreme Court if he does not say he is in favor of upholding the Roe v. Wade decision that legalized unlimited abortions. Roberts is expected to be asked about Roe during the Senate Judiciary Committee hearings September 6.

Boxer said that she will both vote against Roberts and bring Senate activity to a halt if she doesn't get satisfactory answers to her questions about Roberts' abortion views.


If he declines to answer the questions, Boxer will "use all the parliamentary tools I've been given as a U.S. senator" including procedures that "make it difficult for other business to get done until we get the information we need."

Sounds like a litmus test to me. Sean Rushton' director of the Committee for Justice, a group that backs Roberts agrees. He said Boxer's views amount to a litmus test.
"This is a single-issue litmus test that strikes at the heart of an independent judiciary," he told the Washington Times. Boxer claimed if Roberts opposes Roe and is approved for the high court, America will go back "to the days of back-alley illegal abortions."

"We cannot go back to those dark days,' she said. "Judge Roberts cannot duck this issue."

Project Max - Show Planned Parenthood the difference between right and wrong

In response to the overwhelming response to the outrageous Planned Parenthood Golden Gate's "A Superhero for Choice" cartoon, Dawn Eden at The Dawn Patrol has created an action plan to expose the actions of Planned Parenthood and its despicable video to a broad audience. Dawn is calling for good people to contact their local newspapers, radio and TV stations and tell them of the video and how Planned Parenthood is now trying to cover its tracks by removing the cartoon from its site.

The following are five things you can do to take part in Project Max. Even if you can do only one of these, it will make a significant difference in getting the message out:

1. Today (August 11) and tomorrow, contact the largest newspaper in your area and tell them about "A Superhero for Choice."

2. Contact the Associated Press.

3. Call into your favorite talk radio show and tell them about the cartoon.

4. Inform a leader of your house of worship about the cartoon—and also tell someone who has a different faith than yours, or who is not religious at all, about what the cartoon is and why they should care.

5. Contact a pro-life organization and find out what you can do to help them, through giving of your time or money.

The Devil Made the ACLU Do It

The ever anti-religion-in-the-public-square stance of the ACLU is exposed for the deceptive sham that it is. On Tuesday, August 9th, ACLU lawyers filed an appeal to the Supreme Court to overturn a US 4th Circuit Court of Appeals decision which denied a Wiccan priestess' suit to offer prayers before a Chesterfield, Virginia Board of Supervisors meetings.

From The Washington Times:
... In their petition, received by the court yesterday, American Civil Liberties Union lawyers accuse the federal appeals court of trying to "obscure with legal smoke and mirrors" Chesterfield's preference for mainline religions.

"Although Establishment Clause jurisprudence may be beset with conflicting tests, uncertain outcomes and ongoing debate, one principle has never been compromised ... that one religious denomination cannot be officially preferred over another," ACLU attorneys wrote in their 13-page filing.

County officials said they had the right to limit the prayers to Judeo-Christian beliefs and religions based on a single god.

Though many variations exist, the Wiccan faith is a generally a multi-deity religion with strong focus on Earth and seasonal cycles, also defined as a form of witchcraft.

In a half-truth explanation of the 1st amendment an ACLU spokesdemon said:
"The First Amendment prohibits governments from having an official religion," ACLU Virginia's legal director, Rebecca Glenberg, said in an interview.

The fact of the matter is that the 1st amendment defines a two part protection of the freedom of religion:
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."

As always, the communist left purposely omits the second half of the freedom of religion guarantee in the 1st amendment when it argues against Judeo Christianity in American life. It has been said so many times, in so many ways, by so many people that the ACLU is not anti-religion. It is just anti-Judeo Christian religion. All other religions enjoy a special place in the ACLU's place where a heart belongs.

9th Circuit upholds the will of the people of Arizona ... for now

In a rare exercise of restraint, the 9th Circuit Court of Appeals in San Francisco refused to overturn a portion of Arizona's proposition 200. The proposition, passed in November 2004, bars illegal immigrants from receiving certain public benefits, makes it a crime for public employees to fail to report undocumented immigrants who seek the benefits outlined in the legislation and requires people to show proof of citizenship when registering to vote.

Only the provision barring illegals access to public benefits was challenged by the Mexican American Legal Defense and Educational Fund. The three judge panel ruled that the plaintiffs had no right to sue.

An Associated Press article published on states:
The plaintiffs had asked the appellate court to rule that U.S. District Judge David Bury had abused his discretion by refusing to grant a preliminary injunction until a trial is held to determine whether the benefits prohibition is constitutional.

The provisions dealing with voters weren't affected by the challenge.

The three-judge panel's order said the plaintiffs hadn't demonstrated they were hurt by implementation of the law or been charged or specifically threatened with prosecution. Also, there was no allegation of a First Amendment injury that would lower the legal hurdle in front of the right to sue, the order said.

NCAA Mascot Mania

Jeremy Robb at ChronWatch has written a scenario which takes the recent NCAA ban on post-season use of Indian mascot names to its logical conclusion.
NEW YORK, New York --- Ireland became furious over a recent announcement by the NCAA to ban Native American mascots in tournaments due to their abusive and hostile nature...


Meanwhile, other groups also felt slighted by the ban. Greeks began legal work to ban Spartan mascots from any tournaments. Descendants of the ancient city of Troy started rumblings about banning the Trojan mascot. Satanists demanded that mascots like the Blue Devils and Sun Devils be banned for insensitivity to Satanic religious beliefs. The United Way asked that the Tennessee Volunteers not disrespect volunteers around the country with their insensitive use of the term as a mascot. Pope Benedict XVI chimed in and demanded that Saints also be banned as mascots during tournaments. Spock demanded that the NCAA ban the University of Hawaii-Hilo from using the Vulcan mascot. Upon hearing the news, President Bush sent word that he was offended by Emory and Henry College's use of the Wasp mascot. PETA threatened to kill all NCAA directors if they did not include a ban on any and all animals as mascots, claiming the emotional distress caused to animals by exploiting them as mascots is irreversible in many cases.

There has to be an ACLU lawyer behind this somewhere.
